4. Investment Calculation

The total investment is calculated as the cumulative sum of monthly subscription fees paid during the guarantee window.

5. Revenue Recognition & ROI Calculation

5.1 Included Revenue

Direct attributed sales generated through AI-driven lead nurturing, automated booking sequences, and reactivation campaigns within the 180-day period.

5.2 Excluded Revenue

Organic direct-to-site traffic without AI interaction, renewal of existing contracts signed prior to the Guarantee Start Date.

6. Guarantee Execution

6.1 If the 3X ROI threshold is not achieved by Day 180, the following procedural steps take place:

No-cost service extension (Monthly fee waived).

STEP 03

Performance optimization until 3X ROI is met (Max 360 days).

6.2 Guarantee Limitations

This is a Performance Extension Guarantee. No cash refunds will be issued. Magic Suite’s sole liability is the continued provision of services and labor at no cost until the ROI threshold is achieved.

7. Client Obligations & Compliance

7.1 Mandatory Data Provision

Client must provide "Read-Only" access to CRM and Merchant Processor (Stripe/PayPal) for revenue verification purposes.

7.2 Ongoing Compliance

Client must respond to AI-generated leads within 4 business hours and maintain a minimum "Lead-to-Appointment" conversion rate of 15% via their internal sales team.

8. Guarantee Disqualification

Unauthorized modification of AI system prompts or workflow logic.
Failure to pay monthly subscription fees on time (Late > 3 days).
Intentional misreporting of sales data.
Discontinuation of ad spend below the agreed-upon baseline.

By accepting AutoScale AI PRO MAX services, the Client acknowledges that they have read, understood, and agreed to the 180-Day 3X ROI Performance Guarantee Term Sheet as a non-negotiable addendum to the Master Terms of Service.
